Court Slams Hospital Administration for Lapses, Raises Concerns Over Evidence Tampering
August 13, 2024, Kolkata — The Central Bureau of Investigation (CBI) has officially taken charge of the investigation into the horrific rape and murder of a 31-year-old doctor at Kolkata's RG Kar Medical College and Hospital. This move comes just hours after an order from the Calcutta High Court, which highlighted serious lapses in the hospital's administration and the initial investigation.

The tragic incident occurred when the doctor was found dead in the hospital’s seminar hall on Friday morning. Her body bore multiple injuries, and her clothes were in disarray, suggesting a brutal assault. The court noted the hospital's failure to respond adequately after discovering her body, raising concerns about possible evidence tampering.

The victim’s parents expressed a desire for an independent investigation to ensure a fair probe. The High Court strongly criticized Dr. Sandip Ghosh, the former principal of RG Kar Medical College, for his lack of proactive measures following the incident. It was particularly critical of the state's decision to appoint Dr. Ghosh as Principal of Calcutta National Medical College just hours after his resignation, which sparked protests among doctors and the public.

"The circumstances under which Dr. Ghosh resigned should have been carefully considered," the court stated. "It is troubling that he was reassigned to a similar position of responsibility immediately after stepping down. He should have been relieved of all duties pending a thorough investigation."

The court emphasized that Dr. Ghosh should have been one of the first individuals interviewed by investigators. "We do not question his professional qualifications, but as an administrator, his role in this incident must be scrutinized. His statement should have been recorded without delay."

The High Court also criticized the hospital administration for not supporting the victim or her family, expressing concern that evidence might be tampered with if the case was not handled by an independent agency. "This is a unique and serious case. We cannot afford to lose more time, as there is a real possibility that crucial evidence could be destroyed," the court stated.

Given the lack of significant progress in the investigation by the state police, the High Court ruled that the case be transferred to the CBI immediately. "Under normal circumstances, we would allow more time for the state police to conduct their investigation, but in this instance, we believe that the transfer to the CBI is justified to ensure that justice is served," the court concluded.

Earlier, West Bengal Chief Minister Mamata Banerjee had urged Kolkata Police to complete their investigation by Sunday, warning that the state government would recommend a CBI probe if requested by the victim's family. The BJP and other opposition parties have also demanded a central agency investigation, citing concerns over potential evidence tampering if the state police were left in charge.

The case has drawn national attention, with widespread calls for a thorough and transparent investigation to bring the perpetrators to justice. The CBI is now tasked with ensuring that all aspects of the case are examined meticulously, and that those responsible for this heinous crime are held accountable.
